What is the scope of this policy ?

This Policy applies to any user browsing the Site (hereinafter the "User(s)" or "You", "Your", "Your").

The Company is committed to protecting the privacy of the Users of the Site in accordance with legal and regulatory requirements, and in particular the Regulation n°2016/679 of April 27, 2016 (known as the "General Data Protection Regulation" or "GDPR") and the law n°78-17 of January 6, 1978 (known as the "Data Protection Act"), (hereinafter the "Applicable Regulation").

The purpose of this Policy is to specify to You, as a User of the Site, the personal data concerning You that we may collect and process when You visit the Site.

What data is collected ?

We may collect personal data from You, or receive personal data from You, through our websites, Company product or brand pages on social media, or by other means. In some cases, You provide personal information directly to us (e.g., when You create an account, when You contact us, or when You make a purchase on our websites or in a store). In other cases, we collect such data (e.g., by using cookies to understand how You use our website).

The Company may collect the following personal data such as Your last name, first name, address, postal code, city, country, telephone number, Your identifiers (email address and password), the name of the company to which You are attached, its SIRET number, a contact for delivery and, if applicable, the intra-community VAT number. Your bank details are collected by our trusted third party Ingenico.

This data may be collected by the Company in particular during the following operations (i) when creating a User account on the Site, (ii) when ordering products on the Company's Site and (iii) during the User's optional registration for contests, promotional offers or during sponsorship operations organized by the Company.

The Company may collect data through the use of cookies or similar technologies. Cookies are small text files that are used to store information on web browsers. These files allow the exchange of status information between the Site and the User's browser. They allow the Company to remember the User when he/she uses the Site and to record his/her browsing history. For what purposes is the data collected used ?

The data marked with an asterisk (*) on the account creation form are necessary to provide You with the services and are used in particular to (i) manage the procedure for creating the User account and the User account, (ii) provide the services offered on the Site and in particular to allow the User to purchase goods on the Site, (iii) process your order, manage invoicing and payments and, more generally, the commercial relationship that You have with the Company, (iv) deliver the products ordered on the Site (v) to contact You directly in the event that the Company has difficulties in processing an order, a request or in delivering the goods, (vi) to respond to requests from Users and to communicate with them concerning the products and services offered by the Company, their opinion on the products and services provided by the Company and important changes and evolutions of the products and services offered by the Company, (vii) to apply the legislation and regulations in force, (viii) to evaluate your solvency if necessary and (ix) to detect cases of fraud with the bank card and/or the customer account

Other data is optional and is collected only for the purpose of (i) establishing statistics relating to traffic on the Site, (ii) managing the User's subscription to newsletters and commercial prospecting messages sent by the Company, (iii) managing the participation of Users in promotions and contests organized by Café Royal Pro and (iv) customizing the services offered to Users.

 

What is the legal basis for our use of your data ?

The processing carried out by the Company using Your personal data is based on the legal grounds necessary for the execution of a contract binding the User to the Company; this includes in particular the processing whose purpose is the creation and management of the User account and the provision of services, including in particular the delivery of the goods ordered on the Site. 

This processing is also based on the legitimate interest of the Company (and in particular its economic interest); it is in particular the processing whose purpose is to maintain the security of our Site and to ensure its protection against fraud, the realization of statistics, the resolution of any technical problem, the improvement and the development of new functionalities according to the use and/or the returns and requests of the Users and the management of the Site and its operational functions (including logistic).

Indeed, these processing operations contribute to the security and improvement of its Services by the Company and thus benefit both the Users and the Company without infringing the interests, rights and fundamental freedoms of the Users.

It is also specified that for commercial prospecting operations, the consent of the User acting in a personal capacity (except for orders made on behalf of a company) is specifically collected. In any case, Users (acting in a personal or professional capacity) have the right to oppose the receipt of electronic communications at any time.

 

How long will your data be kept ?

The Company keeps the personal data for the duration of the User's personal account activation. The User has the possibility to close his space at any time by sending a request by email to In this case, the Company will delete all the personal data it has of the User from the active database on which they are stored, with the exception of data that are necessary to fulfill its contractual or legal obligations, including accounting. The data is then archived for the duration of the applicable statute of limitations before being permanently deleted after this period.

We may retain certain personal data despite Your objection to their retention in order to fulfill our legal or regulatory obligations and to enable us to exercise our rights (e.g., to bring an action before any court and or defend ourselves in an action before a court).

 

With whom do we share your data ?

The Company undertakes to keep Users' personal data confidential and to share it only in the circumstances described below and in accordance with the Applicable Regulations.

Personal data is only accessible internally to those departments that need access to the data for the purposes mentioned above, namely mainly the Customer Service, the Logistics Department to ensure the delivery of Your order, the Accounting Department, the Marketing Department, the Sales Department and, if necessary, the IT Department.

We may collaborate with service providers acting as subcontractors within the meaning of the Applicable Regulations to perform services in connection with the services we provide to Users through the Site. These service providers intervene in particular within the framework of hosting, storage, analysis, marketing, communication, accounting, delivery, payment, data processing, database management or computer maintenance services.

These service providers act only on the instructions of the Company and will have access to Users' personal data only to perform these services and will be bound by the same security and confidentiality obligations as the Company.

The personal data collected by the Company is stored on servers owned by the Company located in the European Economic Area.

In addition, personal data collected by the Company may be transferred, in the context of customer service, to a telephone service provider established outside the European Union, and in particular in Morocco and/or Madagascar.

The Company carries out this operation in a secure manner and in compliance with the Applicable Regulations, i.e. the standard contractual clauses approved by the European Commission have been signed with this service provider.

In the event that the Company makes other transfers of personal data outside the European Union to countries that do not have a law governing the use and transfer of personal data that is considered adequate by the European Union, we undertake to take all necessary safeguards to ensure that the third parties concerned comply with the terms of this Policy. These measures may include signing appropriate EU-approved standard contractual clauses.

 

How do we ensure that your data is protected and secure ?

The security of personal data is one of the Company's priorities. The Company undertakes to take all reasonable and appropriate organizational and technical measures to prevent any disclosure, use, alteration, accidental loss or destruction of personal data provided by a User.

The bank details provided will be stored by our payment service provider Ingenico, which ensures the security of such data.

 

Do we use your data for marketing purposes ?

The Company may send You, as a User of the Site or as a customer, advertisements and updates according to Your choices.

The French rules applicable to commercial prospecting are different depending on whether You are a customer acting in a professional capacity or whether You are a customer acting in a personal/domestic context.

This is materialized on the Café Royal Pro account creation interface in the company name section.

As a "business" customer, we will send you marketing messages unless You have opted out of receiving them.

Our marketing messages contain an "unsubscribe" option if You no longer wish to receive special offers. You can simply click on the unsubscribe link in the email message. Upon receipt of this response, we will remove Your email address from our distribution list. If You have multiple addresses known to the Company, You will need to include these different addresses in Your response in order for us to consider Your objection for all addresses.

 

What are your rights regarding the use of your data ?

A right to data portability: You have the right to receive the personal data about You that You have provided to us and that are present on our database, in a structured, commonly used and machine-readable format. A right to withdraw your consent at any time for data processing based on consent: The withdrawal of this consent does not affect the lawfulness of the processing based on consent carried out prior to the withdrawal thereof.
